ILC successfully helped our client to obtain his PR whose student visa was cancelled and a Partner (Temporary) visa was refused at the first instance.
We represented our Turkish client who had his student visa cancelled in 2011 due to his breach of student conditions (i.e. course enrolment, progression and attendance). Migration and Refugee Tribunal (MRT) had decided to revoke his cancellation.
In November 2016, we again represented for him in appealing a decision of refusal in relation to his Partner (Temporary) visa application. We successfully convinced the MRT that he has a genuine compelling reason for DIBP to waive Schedule 3 requirement. His wife has suffered serious mental issue due to his visa refusal, and we presented their unfortunate situation to MRT in order to grant him a PR visa.
He has now successfully been granted a Partner visa. Our client and his wife are very delighted and relieved that they will be able to continue their life together in Australia. They are now able to build their own family and have children as the visa issues have been resolved.
